After receiving word that the makers of the Emerald Speed Rezzer have indeed pursued legal actions in the form of lawsuits against all other rezzer gesture makers and distributors, the makers and distributors of the Cool Viewer and Impudence Viewer, and even Linden Labs, this has gotten way out of hand.
I contacted every member of the Emerald Viewer Development Team, notifying them of the entire situation. After a long conversation with Phox, this post has been made on the Modular System blog, responding to the situation.

It has recently come to our attention that there is fierce competition surrounding certain gestures which claim to "Speed up" your rez time by changing your draw distance incrementally.
These gestures cause you to re-render the same objects, increasing lag for you, and for everyone else in the sim with you.
Anyone selling or distributing these gestures and claiming ANY affiliation with Emerald is misrepresenting their product. We do not endorse or authorize the use of the name Emerald Viewer in any commercial products without prior approval.
They should not be used under any circumstances, and will not function in our next release."
I sincerely hope that their actions will end this fiasco and mockery of the the legal system, and the unbridled abuse of the DMCA by the makers of Emerald Speed Rezzer.
